MicroSystems Legal Information

Limited Warranty of MicroSystems Engineering, Inc. 

In connection with, and in consideration of the sale of a certain computer system by MicroSystems Engineering, Inc. of Kokomo, Indiana ("Microsystems") to Purchaser, Microsystems extends to Purchaser a Limited Warranty covering the computer system component parts and labor provided to the Purchaser. MicroSystems warrants and agrees to repair any of its work or replace any component parts which are defective, faulty or otherwise which fail to substantially conform with the express terms of the sale.  This warranty is extended to Purchaser for the period of one year from the date of purchase, which period is defined to commence on MicroSystems' date of final invoicing.  For Purchaser to invoke the warranty remedies set forth herein, Purchaser must give MicroSystems written notice, within 10 days of the occurrence or manifestation to Purchaser of the defect, and within the one-year warranty period, specifically identifying the alleged defect and its alleged cause.  Failure of Purchaser to give timely notice renders this warranty void and releases MicroSystems of all obligations in connection therewith.  THE WARRANTIES SET FORTH HEREIN ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, AND NO OTHER REPRESENTATION, WARRANTIES, PROMISES OR STATEMENTS HAVE BEEN MADE BY MICROSYSTEMS WITH RESPECT TO THE COMPUTER SYSTEM SALE DESCRIBED HEREINABOVE AND THE LABOR OR PARTS COVERED BY THIS WARRANTY.  ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED BY MICROSYSTEMS.  LIABILITY FOR CONSEQUENTIAL DAMAGES UNDER ANY AND ALL WARRANTIES IS EXCLUDED TO THE EXTENT EXCLUSION IS PERMITTED BY LAW.  MICROSYSTEMS' LIABILITY SHALL BE LIMITED SOLELY TO THE REMEDIES EXPRESSED IN THIS WARRANTY.  This is the sole and exclusive remedy and warranty of MicroSystems.  However, MicroSystems transfers, conveys, and assigns to Purchaser any and all manufacturers' warranties of the component parts installed by MicroSystems in connection with the sale of this product to Purchaser.

Terms of Sale

1.)  MSE retains a security interest in all goods until payment is made in full.

2.)  A $25 fee will be charged for all returned checks.

3.)  A 15% restocking fee may be charged on All Goods Returned for Credit.

4.)  A 18% per annum finance charge will be assessed on all overdue notices.

5.)  In the event of dispute the venue for litigation will be in Howard County, IN.  In the event of default of this agreement, the prevailing party in the legal action is entitled to recover attorney fees and court costs incurred in the settlement of the matter.

6.After the initial warranty period (one-year), the customer is responsible for any shipping charges incurred in the returning of warranty items.

7.)  Customer is responsible for providing shipping material for items needing return to manufacturer, i.e. save your original boxes for items such as monitors and printers.  This applies both in and out of warranty.

Turn Off Computer? You are doing everything you can to cut back on energy costs.  Is it more energy efficient to put your computer in sleep mode or repeatedly turn it on and off?  According to experts at the Department of Energy, computers in sleep mode use about seventy percent less energy than what is used when a computer is awake.  If you plan to leave your computer for longer than two hours, you should shut it off.

Upgrade or Buy New Computer Typically, we would recommend if replacing two major components inside a computer, we feel the customer is better off to replace the computer. The technology in computers is changing on a daily basis, and if one upgrades more than two major items it is better to upgrade the entire computer system. The good news is that monitors, keyboards, mice, and speakers can be used with a new computer system, to save the customer unneeded cost.

Cable versus DSL Service Many ask for recommendations on cable modem or DSL service, when upgrading from dial-up service. There are two basic differences between the two types of service. Cable modem service is slightly faster than DSL service, however most will not be able to tell much difference between the speeds. The other major difference is that DSL service is usually cheaper in most areas.  Please be sure to check with local providers for pricing.

Backing Up Data The best way to keep your data safe on your computer is to regularly back up your data. Even the best computers in the world have failures that are unpredictable, and with redundant data one can recover any lost data. The easiest way today to back up your data is to place the data on a recordable DVD. Be sure to ask us about our other back up options for businesses or those with critical data.
